Spouse and Spouse's Children Visa
United States citizens whose spouses reside outside of the United States may apply for their spouse and spouse’s minor children to obtain a K-3/K-4 nonimmigrant visa.
This visa should be obtained if the spouse of the U.S. citizen is currently living outside of the United States and would like to be admitted into the United States while they wait for the processing for permanent residence to be completed. See our section on Green Card through family for more information on the permanent residence application process.
There are several benefits to applying to a K-3/K-4 visa:
- Shorten waiting period for non-citizen spouses to enter the United States
- Qualify for change of status for permanent residence once admitted
- Qualification to obtain employment authorization immediately after admittance
