Driving While Ability Impaired by Drugs (DWAI Drugs) - VTL § 1192.4

A person is guilty of DWAI Drugs if he/she operates a motor vehicle while the person’s ability is impaired the use of a drug as defined in the vehicle and traffic law.

If convicted of DWAI Drugs, you will be guilty of a misdemeanor, which results in a lifetime criminal record. Although the government must only prove that you were impaired by the drugs and not intoxicated (the difference between DWAI and DWI) the consequences of DWAI Drugs basically mirror those in place for DWI offenses, not DWAI. One difference is that a conviction of DWAI Drugs may render you ineligible for a conditional license.
